Reminder re: Implementation of CM/ECF Filing Agent on July 16, 2012

ATTENTION ATTORNEYS, TRUSTEES AND U.S. TRUSTEE

This is a reminder that on July 16, 2012, the Court will implement CM/ECF Filing Agent. Filing Agent is an optional feature that enables registered CM/ECF users to assign unique logins and passwords to support staff filing electronic documents on their behalf.

The Court has posted an Electronic Learning Module (ELM), containing the necessary steps to associate a Filing Agent to a registered CM/ECF user.

We encourage all registered CM/ECF users who are interested in using Filing Agent to review the ELM and become familiar with the process.

Public Notice re Santa Ana Case Assignment to Judge Clarkson

Judge Scott C. Clarkson recently began receiving a portion of the new chapter 7 and chapter 11 bankruptcy cases filed at the Santa Ana Division. Judge Clarkson will also continue to receive new cases filed at the Riverside Division.

Hearings: To schedule matters on Judge Clarkson’s Santa Ana Division calendar, please refer to Judge Clarkson’s self-calendaring instructions on the Court’s website at www.cacb.uscourts.gov, or call 714-338-5378.

Unless otherwise directed by the Court, parties appearing before Judge Clarkson for Santa Ana Division cases assigned to him are to appear at the Santa Ana Division, Courtroom 5C. Hearings for Judge Clarkson’s Santa Ana Division cases should be noticed for his Santa Ana Division Courtroom at 411 West Fourth Street, Courtroom 5C, Santa Ana, CA 92701.

Filing Papers/Judge’s Copies: Papers filed on Santa Ana Division cases assigned to Judge Clarkson must be filed either electronically or, for those not registered to use CM/ECF, at the Intake Section of the Santa Ana Division. Judge’s copies of these documents must be mailed to 411 West Fourth Street, Suite 5113, Santa Ana, CA 92701, or placed in the judge’s copy bin for Judge Clarkson outside of Suite 5113.

Chapter 13 Plan Addendum Appears to be Moot According to the Court?

Good morning,

Consumer Bankruptcy attorney’s are well aware of the Addendum, the local form attached to the Chapter 13 Plan. And as we all know, there have been several years of litigation regarding the form, much of it spearheaded and defended by the law firm of Borowitz and Clark.

Well please see below from the Court’s Web Page. The use of the Addendum now appears to be moot according to the Court.

FYI, that is exactly what Judge Kaufman told me in court a couple of weeks ago. Although, she added that Debtors can still use the Real Property Addendum if they wish. Our office will definitely continue to attach it to all Chp. 13 Plans for Debtors who own real property.

Court To Implement CM/ECF Filing Agent on July 16, 2012

On July 16, 2012, the Court will implement CM/ECF Filing Agent. Filing Agent is an optional feature that enables registered CM/ECF users to assign unique logins and passwords to support staff filing electronic documents on their behalf. Filing Agent will also provide all registered CM/ECF users with the ability to maintain email account information via the Utilities > Maintain Your ECF Account hyperlink (pursuant to LBR 2091-1, registered users are prevented from using Filing Agent to change their address).

The Court has posted an Electronic Learning Module (ELM), containing the necessary steps to associate a Filing Agent to a registered CM/ECF user’s profile. Please note that since the ELM was created by the National Training Branch, some CM/ECF screen information depicted in the ELM may be slightly different from the information contained in the Court’s CM/ECF system (i.e., group names).

We encourage all registered CM/ECF users who are interested in using Filing Agent to review the ELM and become familiar with the process. To access the public notice announcing the implementation of this new feature and the ELM for training click this link:

CM/ECF Tips to Avoid Filing Errors

ATTENTION ALL CM/ECF USERS Re: CM/ECF Tips to Avoid Filing Errors

Entering the Jury Demand when Opening an Adversary Complaint:

When Opening and Adversary Proceeding, the monetary value in the Jury Demand field must be rounded up to the nearest thousand. For example, a Jury Demand for $25,000.00 should be entered as 25 only. It is essential that this information is entered correctly so it is accurately reported to the Statistical Division of the Administrative Office (AO).

Was your Client’s Chapter 7 Case Closed Without a Discharge?

Avoid this situation by filing the Financial Management Certification (Official Form 23) within the required time of 60 days from the first day set for the meeting of creditors or after the 341(a) meeting. This will prevent the case from being closed without a discharge, avoid having to file a motion to reopen the case and paying reopening fees.

Word Version of LBR Order Forms Revised

ATTENTION RE: Word Version of LBR Order Forms Revised

The Court has updated all of the Word versions of its LBR (Local Bankruptcy Rule) order forms so that the forms are compatible with LOU and streamline processing for the Court. The forms have been posted on the Court’s website. Please begin using these modified LBR order forms immediately when lodging an order through LOU.

These order forms include the Proofs of Service of Document and Notice of Entered Order that became effective June 1, 2012. No other text on these order forms has been changed, nor have the form revision dates. The Court is currently updating its other LBR forms to be more compatible with CM/ECF and to include the new Proof of Service of Document and Notice of Entered Order. A notice will be sent when this project has been completed.

Notice from the Clerk:

The U.S. District Court for the Central District of California has a new public (Internet) website.  Official launch date is scheduled for Monday,  May 7, 2012; however, users may experience interruptions beginning 5:00  p.m. Friday, May 4th.
