Debtor Electronic Bankruptcy Noticing (“DeBN”)

The bankruptcy court has recently initiated a pilot program called the Debtor Electronic Bankruptcy Noticing (“DeBN”). DeBN gives debtors the opportunity to request receiving court orders and court-generated notices via email rather than by U.S. Mail to their mailing address.
The court began testing DeBN on February 24, 2014, and the court will conclude the pilot program on May, 2014. The ability for the debtor to receive court orders and court-generated notices by email has several advantages:

-It’s fast – Debtors receive court orders and court-generated notices quickly, often on the same day they are filed.
-It’s convenient – Debtors can read and/or save the court orders and notices on their mobile device, iPad, and home computer.
-It’s free – Court orders and court-generated notices can be viewed an unlimited number of times on the debtor’s mobile device or home computer at no charge.
-It’s green – less paper clutter.

Attached  hereto is additional information about how both represented and pro se debtors can request having court orders and court-generated notices sent to them via email from the court.

CM/ECF Docket Event Updates Effective December 1, 2013

ATTENTION ECF USERS:

Attached is a summary of CM/ECF docket event changes that will take effect on December 1, 2013, to coincide with the amendments to Bankruptcy Rules and Official Bankruptcy Forms, and changes to the Bankruptcy Miscellaneous Fee Schedule, which will also take effect on December 1, 2013.

New Docket Event for Transcript Order Form

ATTENTION ECF USERS:

Effective November 25, 2013, when requesting a transcript of a hearing, file the Transcript Order Form in CM/ECF using new docket event, Transcript Order Form (Public Request).

Revised Transcript Ordering Instructions and Form (rev. date is November 25, 2013) are located at http://www.cacb.uscourts.gov/track-transcript-status

Upon receipt of the Transcript Order Form through CM/ECF, the Clerk’s Office will prepare and transmit the Court’s records of the hearing to the Transcriber. The Clerk’s Office will then docket a Transcript Records Transmittal and relate it to the Transcript Order Form. More information regarding these docket events and tracking the status of a transcript is located on the Court’s website at http://www.cacb.uscourts.gov/track-transcript-status

Availability of highly trained staff for hire

As many of you are aware, due to the decline in bankruptcy filings and the earlier mandated budget cuts, our Bankruptcy Court has had to incur recent significant staff layoffs and early retirements. 18 of our fellow bankruptcy staff throughout the Central District have been laid off effective Friday, October 4th, with many others taking early (often to their overall career plans — premature) retirement. These staffers are highly trained in their respective bankruptcy fields.

Proudly, our Court has set up a set separate department in Los Angeles to serve as a clearinghouse for ALL the divisions for people looking for trained bankruptcy staff to hire. If you are looking for highly trained and motivated legal staff to hire or are aware of possible employment opportunities throughout the Central District, please forward these inquiries and leads to Ms. Sandoval. Filing Adversary Complaints on Closed Cases

Attention ECF Users:

Effective on Monday, September 30, 2013, the CM/ECF system will be modified to permit the filing of an adversary complaint to determine whether a particular debt is exempted from discharge without reopening the main bankruptcy case or paying a filing fee.

New Electronic Summons! (Effective September 23, 2013)

The Court will soon be implementing an automated process for issuing a completed Summons (or Alias Summons)and Notice of Status Conference Summons) in an adversary proceeding.

Under this new automated process, plaintiffs will no longer need to lodge a proposed form of Summons in order to have a Summons or an Alias Summons issued in an adversary proceeding as currently required by Local Bankruptcy Rule 7004-1(a).  The Court will prepare the required Summons or Alias Summons.  Plaintiffs who are registered CM/ECF users will receive an issued Summons or Alias Summons electronically (by Notice of Electronic Filing — NEF).  Plaintiffs who are not registered CM/ECF users will receive a printed copy of the issued Summons or Alias Summons by U.S.mail.  Local Bankruptcy Rule 7004-1(a) will be revised in the future to accommodate these changes.

All plaintiffs will continue to be responsible for serving the completed Summons on all defendants, as required by Local Bankruptcy Rule 7004-1(b) and FRBP 7004.

Request For Comments on Proposed Local Bankruptcy Rules Amendments

Relocation of CM/ECF Email Delivery Servers

To All ECF Users:

The Court was recently notified that in August, the Administrative Office of the U. S. Courts moved the location of its CM/ECF email delivery servers to provide for better backup and recovery.  As a result of the migration, several new Mail server Internet Protocol (IP) addresses were assigned to the CM/ECF email delivery application.

Because the migration involved a network location move, we have been monitoring the bounce-back of NEF deliveries to ensure that the Internet Service Providers for our registered CM/ECF users are not blocking NEF deliveries from these new IP addresses.

We are unsure of the impact of this change but believe the majority of court users will be unaffected.  However, if you believe that you are not receiving NEFs, you should contact the ECF Help Support Desk immediately at (213) 894-2365.  Because the migration involved a network location move, if you are not receiving notices, you may need to contact your Internet Service Provider to have the new uscourts.gov Mail server IP addresses shown below whitelisted.

Request for Volunteers from the Bar

ATTENTION MEMBERS OF THE BAR:

The Bankruptcy Court for the Central District of California is seeking members of the Bar who represent debtors to assist with the testing of a pilot program called Debtor Electronic Bankruptcy Noticing or DBEN. DEBN will allow debtors to elect to receive entered orders and court-generated notices by email instead of their street address. Debtors will only receive the orders and court generated notices by email that they otherwise would have received by U.S. Mail. The pilot program is a collaboration with the Administrative Office of the U.S. Courts (AO) and the Bankruptcy Noticing Center (BNC). Testing is expected to begin in Fall, 2013, and last approximately 60 days. The deadline to volunteer is Thursday, August 16, 2013. Please see attached document for more information.
