ABI’s Proposed Changes for Small and Mid-Size Businesses

Below is a great article discussing the American Bankruptcy Institute’s proposal to help small business debtors.  The article first apppeared in the WSJ’s DealB%k by Prof. Michelle M. Harner.

When small and middle-market companies fail, families and founders often lose a business to which they have devoted not only most of their time but also most of their life savings, and most of the time the reason why these business fail is because they don’t know what is lead generation, which at the end is a fact that could have prevented the situation. Others lose as well: employees, suppliers, communities and lenders. Consequently, a federal bankruptcy system that effectively and efficiently rehabilitates distressed small and middle-market companies is essential.

Bankruptcy Fees to Increase Dec. 1st

Appealing a bankruptcy order directly to Court of Appeals (bypassing District Court) will go from $157 to $207. 

Motion to Redact information from previously filed records – new charge $25 per case.

Pre-Hearing Disposition Archive Page

Due to popular request, the U.S. Bankruptcy Court would like to announce our new Pre-Hearing Dispositions Archive page. The purpose of this page is to allow users the ability to search for past pre-hearing dispositions.

To access this new page, click the Pre-Hearing Dispositions link from the court’s homepage. Once there, click the Pre-Hearing Disposition Archive tab and enter the year and Judge for the pre-hearing disposition you are interested in. You will be able to search as far back as July 2013.

Zip Codes for Some Cases Assigned to San Fernando Valley are Changing to Santa Barbara

Effective May 10, 2014

Some San Fernando Valley Division Zip Codes Will Move to the Northern Division
Zip codes for the cities of Simi Valley, Thousand Oaks, Westlake Village, Newbury Park, and Malibu, previously used to determine case filings assignments for the San Fernando Valley Division, are reassigned to the Northern Division, regardless of whether cities or zip codes are in Los Angeles County or Ventura County. The zip codes include: 90263, 90264, 90265, 91319, 91320, 91358, 91359, 91360, 91361, 91362, 93062, 93063, 93064, 93065, 93094, and 93099.

Bankruptcy Case Filing Fees Increase Effective 6/1/2014

The Judicial Conference has approved a fee increase effective June 1, 2014.

The fees for filing a chapter 7 case will increase from $306.00 to $335.00.

The fees for filing a chapter 13 case will increase from $281.00 to $310.00

This is a $29.00 increase in the filing fees.

The fees for filing an adversary proceeding will increase to $350.00 (Debtors are not charged filing fees for adversary proceedings).

Chapter 11 filing fees will increase to $1,717.00.
