OCBA’s 5th Annual Consumer Bankruptcy Law Update – October 23, 2018

I have been given the honor of moderating the Orange County Bar Assn’s 5th Annual Consumer Bankruptcy Law Update on Tuesday, October 23, 2018 from 5:30 p.m. – 7:30 p.m. at Chapman University School of Law.   OCBA will be providing a summary of all published case law from the Bankruptcy Appellate Panel, District Court, 9th Circuit Court of Appeals, and US Supreme Court since April last year to now.

Judges Theodor C. Albert, Catherine A. Bauer, Mark D. Houle, Erithe A. Smith, and Mark S. Wallace and Michael J. Hauser of the Office of the US Trustee will be on the panel to discuss key cases.

California Lawyers Association Annual Meeting – September 12-15, 2018 in San Diego

This meeting previously was the California Bar Assn annual meeting.  The MCLE arm of the state bar however separated from the state bar effective the beginning of this year calling itself the California Lawyers Association.  The CLA education programs this year can be found here.  No bankruptcy programs but there are several programs that look interesting including several ethics programs.

Listening Session in Riverside July 9, 2018 re Chapter 13

This is a great concept.  Judge Scott Clarkson, Chair of the Central District of California Case Management Committee, is going to preside over a “Listening Session” which will allow him to listen to “community members and canvass arising issues regarding current chapter 13 procedures after the implementation of the new chapter 13 form plan.”   You can see the flyer here.  Listening Session Clarkson  I might have to attend myself.

     There have been two stunning decisions recently dealing with the common issue of violations of the automatic stay and the discharge injunction. The first is In re Sundquistwhere Judge Christopher Klein in Sacramento awarded $45 million in damages and sanctions against a bank that held a foreclosure sale notwithstanding the prior bankruptcy filing. In In re Marino, Judge Bruce Beesley in Reno, Nevada awarded $119,000 in sanctions and damages when the bank continued contacting the debtor post discharge. Read more…
